Clearwell EDS includes case-specific services to help clients address and successfully accomplish the tasks associated with processing data for analysis, searching, culling, and attorney review. In some instances, this service is advisory and provides assistance in overcoming challenges for onsite employees. In other instances, Clearwell provides staff augmentation to assist clients who are either understaffed or are overwhelmed by a rapid influx in litigation.

Active Matter Services

Clearwell offers a comprehensive set of services designed to help clients with active matters. Key service components include the following and can be customized to meet a client’s specific needs.

  • Search Strategy Assistance: Apply best practices for intelligent culling, identifying false positives, and refining for optimal results
  • Early Case Assessment and Preparing for the Meet & Confer: Apply best practices for determining who knew what and when, identifying relevant topics and keywords, and pre-reviewing case data

Proof of Concept Service

In many instances the best proof of concept evaluation is one that tests the Clearwell application on an active matter, using live data. This real-world scenario helps bring the value proposition into clear focus, resulting in granular metrics that can be evaluated by participating team members. Unfortunately, aggressive deadlines and unique case needs often make it difficult to perform an evaluation on a live case safely, quickly, and defensibly.

To minimize the risk of performing a proof of concept evaluation on an active matter, Clearwell has designed a service to augment staffing, deploy industry-proven best practices, and train both internal and external counsel. The service delivers successful management of an active matter while simultaneously creating an environment that permits objective evaluation.

Clearwell’s Proof of Concept Service has the following components and is delivered in two distinct but interrelated phases.

Phase 1: Set-Up
During the initial phase of the engagement, the EDS team provides consulting to enable the client to successfully and defensibly process, analyze, and review electronically stored information (ESI) for a single test matter including:

  • Case setup and organization
  • Case assessment and iterative analysis
  • Review management

Phase 2: Workflow Optimization
During the second phase, Clearwell’s consultants evaluate the client’s existing processes and make recommendations for an efficient, repeatable, and defensible e-discovery workflow. The client is left with an industry-proven, best practices “recipe” for conducting electronic discovery in-house. The steps in Phase 2 focus on the client’s existing tools and resources and are customized to the client’s use cases including:

  • Sampling and quality control methodologies
  • Metrics for monitoring compliance with, and deviation from, articulated case standards
  • Leveraging tools for Early Case Assessments and Meet & Confer conferences
